AVINUS Technologies is not responsible for any content that you may find offensive or objectionable. AVINUS Technologies maintains sole control over the decisions of the content that is allowed to be posted to Brinewave.com.

At times, objectionable content may be posted against our best efforts to prevent it. By using the Brinewave.com community, you agree that Brinewave.com is not liable in the event that you are exposed to content that you find objectionable or offensive. If you believe there is inappropriate content in our Community, contact support@Brinewave.com.

Brinewave.com may provide at times the ability to report offensive Content by using a button called "Report Offensive Content". Members can report offensive Content using this method.

Pictures and Links

In an effort to foster community growth, our revised community will allow members to have the ability to add certain pictures to their profile. This would allow people to share pictures of themselves, their family, their interests, etc.

Since we are allowing members to add pictures, such as "Avatars", "Signature Pictures" and "Profile pictures", to the web site, we reserve the right to immediately delete any pictures that AVINUS Technologies believes to be inappropriate for the Brinewave.com web site.

Any Member found posting any pictures that contain vulgar, illicit, illegal, and pornographic or other inappropriate content will have their membership with Brinewave.com cancelled immediately.

Members are not permitted to link to any content that is protected by copyrights, that is illegal, or that in any way would cause liability to AVINUS Technologies. By linking to content another website, you agree that you have full permission to do so and indemnify AVINUS Technologies. AVINUS Technologies will cooperate fully with any company who believes that you have infringed on their intellectual property.

Appropriate Online Content

By ("Content"), we mean the software, communications, images, sounds, and all the material and information you see on our Service. Brinewave.com, our Members, our affiliates, and our independent content providers provide most of the Content on Brinewave.com. Brinewave.com does not pre-screen all Content available on our Service. Brinewave.com does not assume any responsibility or liability for Content that is provided by Members or other guests on Brinewave.com. (User Generated Content) Brinewave.com does not endorse, approve, or prescreen any Content that you or other users communicate on the Service. We reserve the right to remove Content that is objectionable to us for any reason. Neither Brinewave.com nor its affiliates assume any liability for any failure to remove, or any delay in removing, Content.

Members and other guests may generate User Generated Content in chat rooms, message boards, and in chat during games, etc. This kind of Content must reflect our standards, and we may remove it if, in our best judgment, it does not meet those standards. When we do, if you are a Member, you may receive a warning from us if your Account (described in Section 2) was responsible for posting the offensive Content. If it's a serious offense or you've violated our rules before, we may ban you from participating on Brinewave.com and terminate your Account.

Strong vulgar language, crude or explicit sexual references, discussions of illegal drugs, and hate speech are offensive and always inappropriate Content for Brinewave.com. In other cases, there may be "gray areas". Always use your best judgment. If you would not say something in a room full of people you have never met, or in the workplace, please don't post it on our message boards or chat. Brinewave.com makes the final determination about whether Content is objectionable or not.

This determination is at our sole discretion, and is final.

Representatives may monitor your communications on Brinewave.com. Because we cannot monitor all of the Content on Brinewave.com, and we do not attempt to do so, you may encounter Content you find offensive.

Your good judgment in making reports, particularly about the opinions of others, is important and appreciated. Brinewave.com does not endorse or oppose the opinions of any Member or guest, but we may take issue with the manner in which an opinion is expressed.

Online Conduct

You agree that you will be personally responsible for your use of the Service and for all of your communication and activity on the Service, luding any Content you contribute, and that you will indemnify and hold harmless AVINUS Technologies, affiliates, AVINUS Technologies', employees, officers, and directors from any liability or damages arising from your conduct on Brinewave.com, luding any Content that you view or contribute.

Online conduct should be guided by common sense and basic etiquette. You will violate the Terms of Service if you (or others using your Account) do any of the following:

• Post, transmit, promote, or distribute Content that is illegal.
• Harass, threaten, embarrass, or do anything else to another Member or guest that is unwanted. This means: don't say bad things about them don't keep sending those unwanted messages, don't attack their race, sexual orientation, religion, heritage, etc. If you disagree with someone, respond to the subject, not the person.
• Transmit or facilitate distribution of Content that is harmful, abusive, racially or ethnically offensive, vulgar, sexually explicit, defamatory, infringing, invasive of personal privacy or publicity rights, or in a reasonable person's view, objectionable. Hate speech is not tolerated.
• Disrupt the flow of chat in chat rooms with vulgar language, abusiveness, hitting the Return key repeatedly or inputting large images so the screen goes by too fast to read, or flooding [posting repetitive text]. This is online vandalism, and it ruins the experience for others.
• You may not impersonate another person (luding celebrities); indicate that you are a BRINEWAVE.COM employee or a representative of BRINEWAVE.COM, or attempt to mislead users by indicating that you represent AVINUS Technologies or any of Brinewave.com's partners or affiliates.
• Attempt to get a password, other account information, or other private information from a Member or any other user on Brinewave.com.
• Remember: Brinewave.com employees will NEVER ask for your password. Don't give your password, reminder words, or other information out to anyone.
• Upload any software or Content that you do not own or have permission to freely distribute.
• Promote or encourage any illegal activity luding distribution of counterfeit software.
• Upload files that contain a virus or corrupted data.

Post messages for any purpose other than personal communication, or transmit advertising, promotional materials, chain letters, pyramid schemes, or make any commercial use of our Service.

Improperly use the in-game support or complaint buttons or make false reports to Brinewave.com staff members.

Obey the rules wherever you are. This ludes rules for use of third party tools, and rules of interactive service providers, state, local, federal laws, or foreign or international law where appropriate. Ignorance of the law is no excuse. Other services on our site have their own rules, and you should consult them before interacting with Brinewave.com.

The following list, which is not intended to be complete, explains what information is not permitted to be posted by any Member in any area on Brinewave.com luding the Community. Members may not submit information that:

• Is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
• Harasses or advocates harassment of another person;
• Exploits people in a sexual or violent manner;
• Contains nudity, violence, or offensive subject matter or contains a link to an adult website;
• Solicits personal information from anyone under 18;
• Provides any telephone numbers, street addresses, last names, URLs or email addresses;
• Involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, or "spamming";
• Furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities luding, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
• Solicits passwords or personal identifying information for commercial or unlawful purposes from other Members or;
• Involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, MLM or pyramid schemes.

Illegal Behavior

The laws that apply in the offline world must be obeyed online as well. We have zero tolerance for illegal behavior on Brinewave.com. We may terminate the use of the Service and cooperate with law enforcement on such matters.

Member Disputes

You are solely responsible for your interactions with other Brinewave.com Members. Brinewave.com reserves the right, but has no obligation, to monitor disputes between you and other Members. If you feel that you are being harassed by another member, please contact support@Brinewave.com to notify Brinewave.com immediately.
